These Terms and Conditions ("Terms") govern your access to and use of edukart.online (the "Platform"), operated by EduKart ("we", "our", "us"). By creating an account, browsing, or purchasing on the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Eligibility

You must be at least 18 years old, or be an educator/institution purchasing on behalf of students, to create an account and make purchases on the Platform. By registering, you confirm that the information you provide is accurate and that you have the legal capacity to enter into this agreement.

2. Account Responsibilities

• You are responsible for maintaining the confidentiality of your password and account
• You are responsible for all activity that occurs under your account
• Notify us immediately if you suspect unauthorized access to your account
• One person or organization may not maintain multiple accounts to abuse promotional offers or coupon codes

3. Products & Digital Delivery

All products sold on the Platform are digital and delivered electronically — typically as an instant download or an access link — upon successful payment. No physical goods are shipped. It is your responsibility to ensure you have a stable internet connection and compatible device/software to access your purchase. Download links generated after purchase are time-limited and tied to your account; please complete your download promptly after purchase.

4. Pricing & Payments

All prices are listed in Indian Rupees (₹) and are inclusive of applicable GST unless stated otherwise. Payments are processed securely through Razorpay. We reserve the right to correct pricing errors and to change product prices at any time without prior notice; price changes do not affect orders already completed.

5. License to Use Digital Products

When you purchase a product, we grant you a limited, non-exclusive, non-transferable license to:

• Download and use the product for your personal or institutional educational purposes
• Print or reproduce reasonable copies for classroom/personal study use, where the product is intended for such use

You may not, unless explicitly stated on the product page:

• Resell, redistribute, or share the product with people who have not purchased it
• Upload the product to other marketplaces, file-sharing sites, or public repositories
• Remove or alter any copyright, branding, or attribution included in the product
• Claim authorship of the product or use it to create a directly competing product

6. Intellectual Property

All content on the Platform — including product listings, descriptions, branding, the website design, and the underlying software — is owned by EduKart or its content creators and is protected by applicable copyright and intellectual property laws. Nothing in these Terms transfers ownership of this content to you beyond the limited license described in Section 5.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Platform, other accounts, or our systems
• Upload malicious code, attempt to disrupt service, or interfere with other users' access
• Use automated means (bots, scrapers) to access the Platform without our prior written consent
• Misuse coupon codes, referral systems, or promotional offers in bad faith

8. AI Chat Assistant Disclaimer

Our website chat widget uses an AI system to answer questions about products and policies. While we ground its responses in our live catalog and published policies, AI-generated responses may occasionally be inaccurate, incomplete, or out of date. The chat assistant does not process payments, issue refunds, or make binding commitments on our behalf — for anything requiring a final decision, please confirm via our Contact Us page or official support channels.

9. Disclaimers

The Platform and all products are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that:

Product descriptions, reviews, and ratings reflect the views of sellers and buyers and do not constitute our endorsement of accuracy or quality beyond our standard content moderation.

10. Limitation of Liability

To the maximum extent permitted by law, EduKart shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Platform. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the specific product giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless EduKart from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Platform.

12. Account Suspension & Termination

We reserve the right to suspend or terminate your account, without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or misused the Platform. You may stop using the Platform and request account deletion at any time, subject to our data retention obligations described in our Privacy Policy.

13. Third-Party Links & Services

The Platform may contain links to or integrate with third-party services (e.g. Razorpay for payments, WhatsApp for support, YouTube/Google Drive for demo content). We are not responsible for the content, policies, or practices of these third-party services.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Uttar Pradesh, India.

15. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by updating the "Last updated" date at the top of this page.
